Creator & Social Media Disclosure Policy

TEMBRY expects advertising, endorsements, creator promotions, and product recommendations connected with the platform to be truthful, transparent, and appropriately disclosed.

1. Scope

This policy applies to creators, influencers, affiliates, ambassadors, employees, contractors, partners, and other people who promote TEMBRY or products available through TEMBRY when they have a relationship that should be disclosed to consumers.

It applies to social media posts, short-form videos, livestreams, stories, photographs, reviews, demonstrations, blogs, podcasts, websites, and other promotional communications.

2. Material Connections Must Be Disclosed

If you have a material connection with TEMBRY, a creator, or another business connected with a product you endorse, that relationship should be clearly disclosed when it would not otherwise be obvious to consumers.

A creator who earns money when a TEMBRY product featuring that creator's work is purchased has a financial connection to the product.

When a creator recommends or promotes a product from which the creator may earn money, the creator should clearly communicate that financial relationship where required by applicable advertising law.

4. Clear and Conspicuous Disclosure

A required disclosure should be presented so that an ordinary consumer is likely to notice, read or hear, and understand it in connection with the endorsement.

Do not intentionally hide a disclosure at the end of a long caption, behind a "more" link, only on a profile page, or inside a large group of unrelated hashtags or links.

The disclosure should appear close to the endorsement or promotional claim to which it relates.

Disclosures should use straightforward language appropriate to the actual relationship.

6. Platform Disclosure Tools

Social platforms may provide tools such as "Paid Partnership," "Sponsored," or similar labels.

Creators should use applicable platform disclosure tools when appropriate, but should not assume that use of a platform tool alone will always satisfy every legal disclosure requirement.

When necessary, include your own clear disclosure in addition to a platform-provided label.

7. Video Content

When an endorsement appears in video content, a required disclosure should be presented in a manner viewers are likely to notice and understand while viewing the endorsement.

A disclosure placed only in a video description may be insufficient when viewers can watch the video without seeing the description.

Depending on the circumstances, both visual and spoken disclosure may help make the relationship clear to viewers.

8. Stories and Image-Based Content

When the endorsement is conveyed through an image, story, or similar visual format, place any required disclosure where viewers can easily notice and read it.

The disclosure should remain visible long enough to be reasonably noticed and understood.

9. Livestreams

When promotional content occurs during a livestream, a single disclosure made only at the beginning may not reach viewers who join later.

Where appropriate, repeat the disclosure periodically so viewers entering at different times can understand the relationship.

10. Truthful Endorsements

Endorsements must reflect the endorser's honest opinions, findings, beliefs, or actual experience.

Do not claim to have used or experienced a product when you have not.

Do not make a positive statement that does not reflect your genuine experience merely because you were paid, received a free product, or may earn money from a sale.

11. Product Claims

Creators and promoters must not make false, deceptive, or unsubstantiated claims about TEMBRY products.

Do not claim that a product is certified, tested, medically effective, safety-approved, stronger than demonstrated, suitable for a regulated use, or capable of performance that has not been established.

Creators should accurately represent materials, dimensions, customization, manufacturing characteristics, and intended use when discussing a product.

12. Reviews and Testimonials

Reviews and testimonials must not be fabricated or materially manipulated to create a misleading impression of consumer opinion.

Do not purchase, create, or coordinate fake reviews, fake engagement, or endorsements from people who have not had the experience they claim to describe.

Any incentive offered in connection with a review should be handled transparently and in compliance with applicable law.

13. Employees, Contractors, and Insiders

TEMBRY employees, contractors, owners, and other insiders should disclose their relationship when endorsing TEMBRY or TEMBRY products in circumstances where the relationship is not already obvious.

The same principle applies to people with personal, family, or financial relationships that could affect the weight consumers give to an endorsement.

14. Affiliate and Referral Links

If TEMBRY later offers affiliate, referral, or commission-based links, participants must clearly disclose when they may receive compensation because someone uses their link or code.

A link, button, tracking code, or creator code by itself should not be assumed to communicate the financial relationship clearly to consumers.

15. Creator-Owned Products

Creators are encouraged to be clear when promoting products they designed, own, or financially benefit from.

Consumers should not be intentionally led to believe that a paid or financially interested recommendation is an independent, disinterested review.

16. TEMBRY Content and Reposting

If TEMBRY reposts, features, or otherwise uses creator promotional content, TEMBRY may preserve, add, or clarify disclosures where reasonably necessary to avoid misleading consumers.

Creators should not remove required disclosures from content merely because TEMBRY has shared or reposted it.

17. Monitoring and Compliance

TEMBRY may review promotional content connected with official creator, affiliate, sponsorship, ambassador, or similar programs for compliance with this policy.

TEMBRY may request correction of an unclear or missing disclosure, inaccurate claim, or other potentially misleading promotional statement.

Repeated or serious violations may result in restriction or termination of participation in a TEMBRY promotional or creator program, subject to applicable agreements and law.

18. Platform Rules Also Apply

Creators must also comply with applicable advertising rules and the terms, advertising policies, branded-content requirements, and other rules of the social platform or service they use.

TEMBRY's policy does not replace a creator's responsibility to comply with applicable law.

19. Changes to This Policy

TEMBRY may update this policy as creator programs, social platforms, advertising practices, or applicable requirements change.

The "Last updated" date will be revised when this policy is updated.

20. Relationship to Other TEMBRY Policies

This policy supplements the TEMBRY Terms of Service, Creator Terms, Acceptable Use & Prohibited Products Policy, and other applicable TEMBRY policies.

Nothing in this policy limits rights or obligations that cannot legally be waived.
