Intellectual Property & Copyright Policy

1. Purpose of This Policy

TEMBRY enables creators and users to submit, display, customize, manufacture, and transact in connection with digital designs and physical products.

This policy explains how TEMBRY handles reports alleging that content available through the platform infringes copyright, trademark, or other intellectual property rights.

2. Creator Responsibility

Creators and users may submit only content that they own or are otherwise legally authorized to use for the purposes for which it is submitted.

Uploading a file, image, model, logo, character, design, photograph, product description, or other material to TEMBRY does not establish that the person uploading it owns the intellectual property rights in that material.

Creators are responsible for obtaining licenses, permissions, or other authorization required for third-party material used in their products or listings.

3. Copyright Complaints

If you believe content available through TEMBRY infringes a copyright that you own or are authorized to enforce, you may send a copyright infringement notice to TEMBRY.

To help TEMBRY evaluate and respond to the notice, please provide:

• A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
• Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved.
• Identification of the material claimed to be infringing and information reasonably sufficient for TEMBRY to locate it.
• Your name and information reasonably sufficient for TEMBRY to contact you, such as an email address, mailing address, and telephone number where appropriate.
• A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
• A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the copyright owner's behalf.

These elements track the information generally required for a copyright notice under the Digital Millennium Copyright Act.

4. Where to Send a Copyright Report

Until TEMBRY publishes separate designated copyright-agent contact information, copyright and intellectual-property reports may be sent to:

5. Review and Removal

TEMBRY may review a sufficiently detailed infringement report and may remove, disable access to, restrict manufacturing of, suspend sales of, or otherwise restrict disputed content while the matter is evaluated.

TEMBRY may contact the person who submitted the content or request additional information from either party when reasonably necessary.

TEMBRY's decision to temporarily restrict content while reviewing a complaint does not constitute a final legal determination regarding ownership or infringement.

6. Counter-Notifications

If your content is removed or disabled because of a copyright complaint and you believe the removal resulted from mistake or misidentification, you may contact TEMBRY to dispute the removal.

Where the statutory DMCA counter-notification process applies, TEMBRY may require the information and statements required by applicable law before processing a counter-notification.

TEMBRY may provide additional counter-notification instructions when notifying the affected user of a removal.

7. Repeat Infringement

TEMBRY may suspend or terminate accounts of users who repeatedly infringe intellectual property rights in appropriate circumstances.

TEMBRY may consider the nature, frequency, credibility, and outcome of infringement complaints, along with other relevant circumstances, when enforcing this policy.

8. Trademark and Other Intellectual Property Complaints

TEMBRY also accepts reports concerning alleged infringement of trademarks, rights of publicity, or other intellectual property rights.

A report should identify the right being asserted, the allegedly infringing content, where the content appears on TEMBRY, the basis for the complaint, and sufficient contact information for follow-up.

Trademark complaints should include relevant registration information when available and explain why the reported use is believed to create an actionable infringement.

9. Manufacturing May Be Suspended

Because TEMBRY may facilitate physical manufacturing, an intellectual property complaint can affect more than a public listing.

TEMBRY may pause or prevent manufacturing, routing, fulfillment, or shipment of a disputed product when reasonably necessary to evaluate a credible intellectual property complaint or comply with law.

10. Misrepresentations and Abuse

Do not knowingly submit false or materially misleading infringement claims or counter-notifications.

Copyright law may impose liability for certain knowing material misrepresentations in infringement notices or counter-notifications.

TEMBRY may take appropriate action against users who abuse the reporting process.

11. No Determination of Ownership

TEMBRY is not a court and generally cannot resolve complex disputes over copyright ownership, trademark priority, licensing scope, patent validity, or other contested intellectual property rights.

TEMBRY may make platform-access and manufacturing decisions based on the information reasonably available without making a final legal determination concerning the parties' underlying rights.

12. Preservation of Information

TEMBRY may preserve records relating to listings, manufacturing files, transactions, infringement reports, counter-notifications, account actions, and related communications when reasonably necessary for platform operations, dispute handling, security, or legal compliance.

13. Relationship to Other TEMBRY Policies

This policy supplements the TEMBRY Terms of Service, Creator Terms, Privacy Policy, and other applicable TEMBRY policies.

Nothing in this policy limits rights or obligations that cannot be waived under applicable law.

14. Changes to This Policy

TEMBRY may update this policy as the platform, Creator Program, manufacturing network, or applicable legal requirements change.

The "Last updated" date will be revised when this policy is updated.
