1. About TEMBRY
TEMBRY ("TEMBRY," "we," "us," or "our") is an online platform for discovering, customizing, ordering, and manufacturing physical products. TEMBRY is currently operated in the United States by an individual doing business under the TEMBRY name.

2. Eligibility and United States Launch
You must be at least 18 years old and legally capable of entering into a binding agreement to create an account, place an order, or otherwise use transactional features of TEMBRY.
TEMBRY's initial commercial service is intended for customers in the United States. We may restrict orders, accounts, shipping destinations, or services outside the United States.
3. Accounts
You are responsible for providing accurate information and for maintaining the security of your account credentials. You are responsible for activity conducted through your account to the extent permitted by applicable law.
You may not impersonate another person, use an account for unlawful purposes, interfere with TEMBRY's systems, or attempt to circumvent security, payment, manufacturing, or authorization controls.
4. Products and Made-to-Order Manufacturing
Many TEMBRY products are made, prepared, configured, or manufactured specifically after an order is placed. Product appearance may have minor variations that naturally result from manufacturing processes, materials, displays, lighting, or finishing.
We may refuse or cancel an order before fulfillment when reasonably necessary, including because of product availability, manufacturing limitations, suspected fraud, pricing or listing errors, safety concerns, legal restrictions, or violations of these Terms. If we cancel a paid order and do not provide the ordered product, we will provide any refund required by applicable law.
5. Customization
You are responsible for reviewing your selected size, color, text, configuration, design options, and other customization choices before submitting an order.
A product that is correctly manufactured according to the selections confirmed with your order generally is not eligible for cancellation, return, or refund solely because you later change your mind about a customization choice, except where otherwise required by applicable law.
If TEMBRY manufactures or fulfills a product materially differently from the confirmed order, contact us so that we can evaluate and provide an appropriate remedy.
6. Prices and Payment
Prices are displayed before checkout and may change before an order is submitted. Applicable taxes, shipping charges, and other charges, when applicable, will be disclosed during the purchasing process.
Payments may be processed through third-party payment providers such as Stripe. Your use of a payment provider may also be subject to that provider's terms and privacy practices.
An order is not guaranteed to enter manufacturing merely because an order request was submitted. TEMBRY may require successful payment, manufacturing validation, or other operational checks before production begins.
7. Cancellations
You may request cancellation before manufacturing begins by contacting [email protected]. We will attempt to stop eligible orders before production begins.
Once manufacturing has begun, an order generally cannot be canceled because the product is being made or prepared specifically for that order.
These cancellation rules do not limit any cancellation, refund, or other remedy that cannot legally be waived under applicable law.
8. Damaged, Defective, Incorrect, or Nonconforming Products
If a product arrives damaged, defective, incorrect, or materially different from the confirmed order, contact [email protected] within 14 days after delivery.
Please include your order information and reasonable documentation of the issue, such as photographs when appropriate. Depending on the circumstances and applicable law, an appropriate remedy may include a replacement, reprint, repair where appropriate, refund, or another reasonable resolution.
Nothing in these Terms eliminates rights or remedies that cannot be waived under applicable consumer-protection law.
9. Production, Shipping, and Delays
Production and delivery estimates are estimates unless TEMBRY expressly states otherwise. Manufacturing time and carrier transit time may vary.
TEMBRY will comply with applicable requirements concerning shipment timing, delays, cancellation opportunities, and refunds. When a delay requires customer notice, consent, cancellation rights, or a refund under applicable law, those rights will apply notwithstanding any other provision of these Terms.
Customers are responsible for providing an accurate and deliverable shipping address. Additional charges or limitations resulting from an incorrect address may apply to the extent permitted by law.
10. Product Safety and Intended Use
Unless a product listing expressly states otherwise, TEMBRY products are not represented as certified or suitable for medical use, life-safety applications, structural or load-bearing safety applications, electrical safety applications, food-contact use, high-temperature environments, or other safety-critical purposes.
Customers are responsible for using products in a reasonable manner and following any product-specific instructions, warnings, age recommendations, or limitations supplied with a product.
11. Prohibited Uses and Products
You may not use TEMBRY to request, upload, customize, manufacture, sell, distribute, or facilitate products or content that violate applicable law or the rights of another person.
TEMBRY may prohibit or restrict categories of products for legal, intellectual-property, safety, platform-integrity, or business reasons. We may reject manufacturing requests that we reasonably determine violate our policies or applicable law.
12. Intellectual Property
TEMBRY's website, branding, software, graphics, interface, original content, and other platform materials are protected by applicable intellectual-property laws. Except as expressly permitted, you may not copy, reproduce, distribute, modify, or commercially exploit TEMBRY platform materials without authorization.
TEMBRY does not claim ownership of intellectual property merely because a user submits content to the platform. However, content submitted for customization, display, manufacturing, fulfillment, support, or related services may require TEMBRY and its service providers to process, reproduce, transmit, display, or manufacture that content to perform the requested service.
Additional creator terms, licensing terms, and intellectual-property policies may apply to users who publish or sell creator content through TEMBRY.
13. User Content and Rights
You may submit only content that you have the legal right to use for the requested purpose. You represent that your submission and the requested use do not knowingly infringe another person's copyright, trademark, privacy, publicity, or other legal rights.
You grant TEMBRY a limited, non-exclusive license to host, process, reproduce, transmit, display, modify as technically necessary, and manufacture submitted content solely as reasonably necessary to operate the platform, provide the requested services, fulfill orders, provide support, maintain security, and comply with law.
14. Third-Party Services
TEMBRY may rely on third-party providers for services such as payment processing, hosting, authentication, storage, communications, shipping, analytics, or manufacturing operations. TEMBRY is not responsible for independent third-party services outside our reasonable control, subject to rights and responsibilities imposed by applicable law.
15. Availability and Changes to the Service
We may modify, suspend, or discontinue features of TEMBRY as the platform develops. We do not guarantee uninterrupted or error-free availability.
We may update these Terms from time to time. When appropriate, we will update the date displayed above and provide additional notice when required by applicable law. Changes will apply prospectively as required by law.
16. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TEMBRY AND THE PLATFORM ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, EXCEPT FOR EXPRESS PRODUCT COMMITMENTS MADE BY TEMBRY OR WARRANTIES THAT CANNOT LEGALLY BE DISCLAIMED.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS WARRANTIES, RIGHTS, OR REMEDIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TEMBRY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE PLATFORM OR PRODUCTS WHERE SUCH DAMAGES MAY LAWFULLY BE LIMITED OR EXCLUDED.
NOTHING IN THESE TERMS LIMITS LIABILITY TO THE EXTENT SUCH LIABILITY CANNOT LEGALLY BE LIMITED OR EXCLUDED. THE APPLICATION OF LIABILITY LIMITATIONS MAY VARY BY STATE AND CIRCUMSTANCE.
18. Suspension and Termination
TEMBRY may suspend or terminate access to the platform when reasonably necessary to address fraud, security threats, unlawful activity, violations of these Terms, abuse of the service, or risks to users, TEMBRY, service providers, or manufacturing partners.
Suspension or termination does not eliminate payment obligations, intellectual-property obligations, or other provisions that by their nature should survive termination.
19. Governing Law
These Terms and disputes relating to TEMBRY will be governed by applicable United States federal law and the laws of the state in which TEMBRY's operator principally conducts the business, without regard to conflict-of-law principles, except to the extent another law must apply.
We have intentionally not included a mandatory arbitration provision or class-action waiver in this initial version of the Terms. TEMBRY may revise its dispute-resolution provisions in the future, subject to applicable notice and legal requirements.
20. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
21. Entire Agreement
These Terms, together with any policies or additional terms expressly incorporated into them, constitute the agreement between you and TEMBRY regarding the matters they address, except where applicable law provides otherwise.
